These Terms and Conditions (“Terms”) constitute the entire understanding and agreement between the Client (“the Client”) and BeFitted Tailoring Co. (“BeFitted”) relating to the purchase of the garment alterations described on the invoice (the “Services”) and supersedes and replaces any and all prior agreements, whether written or oral, that may exist between them with respect thereto. All agreements are final.
I. Cleaning, Acceptance. BeFitted follows standards and policies set by the Fabricare Industry and the International Fabricare Institute. We exercise utmost care in cleaning and processing garments entrusted to us and use such processes which, in our opinion, are best suited to the nature and conditions of each individual garment. However, due to certain circumstances, some garments presented to us for cleaning may present an added risk to the garment and therefore requires our customer be made aware of those risks. BeFitted cannot assume responsibility for inherent weaknesses or defects in materials which may result in tears or development of small holes in fabric that are not readily apparent prior to processing. In dry cleaning and laundering we can not guarantee against color loss, color bleeding, and shrinkage; or against damage to weak and tender fabrics. Silk and satin garments occasionally have weaknesses that are not always apparent prior to dry cleaning. Even with the utmost care we give to these fabrics, some color loss or discoloration may occur if the garment was poorly dyed at the manufacturer. Due to the fine denier used in most silk it has a natural tendency to shift. Because of this shifting, some splitting and/or discoloration may result, especially in certain areas such as elbow, underarm, collar, waist and seat. In addition, some foods, beverages, and cosmetics may also cause splitting or leave permanent stains, or color change. Exposure to sunlight may also cause some color loss. Silks and satins are extremely fragile. Therefore, in time, besides the possible splitting, shifting, discoloration and loss of luster, some piling may occur.We cannot guarantee the complete removal of stains in fabric. Some stains do not appear until a garment is exposed to water, heat, or cleaning compounds. Included, as an example, among causes of this class of problem, are some sugar-based liquids such as contain alcohols or juices. Other causes can occur from attempts by customers to pre-treat their garments prior to sending them for cleaning. We cannot be responsible nor can we guarantee the results of processing garments that have been pre-treated for stains by our customer. Heavily soiled items that have been set over time may not be removed, even when apply industry-grade tactics. We cannot be responsible nor can we guarantee the results when processing garments with no “garment care” tag. In the event that there is a claim the client would like investigate, they must report this to BeFitted within seven (7) days in a written statement.
II. Warranty Disclaimer. The Client acknowledges BeFitted makes no guarantee as to the fit of any garments before or after services are performed. Unless otherwise expressly provided herein, all services are provided as-is, and BeFitted hereby disclaims any and all representations and warranties, express or implied, including without limitation the warranty of merchantability, fitness of a particular purpose.
III. Limitation of Liability. In no event will BeFitted be held liable for any indirect, incidental, special, punitive, consequential, exemplary or similar damages including without limitation, lost profits, loss of use, pain and suffering or mental anguish, related to or arising out of the Services provided. In no event will BeFitted be held liable for any direct damages related to or arising out of the services in excess of the price paid by the Client for the service which is the subject of the claim.
IV. Force Majeure. Any delay or failure in the performance by BeFitted shall be excused if and to the extent caused by the occurrence of a Force Majeure. Force Majeure shall mean a cause or event that is not reasonably caused by or under the control of BeFitted, including acts of God, fires, floods, explosions, riots, wars, hurricane, terrorism, vandalism, governmental acts, injunctions, labor strikes, and errors or omissions of a manufacturer or its distributor.
V. Right of Refusal. BeFitted and/or their contracted seamstresses preserve the right to refuse alterations to any individual under any circumstances at any time.
